“If you withdraw from the ICC that is possible, so from any treaty states can withdraw, but there is a provision which says that your obligation to cooperate continues for the cases that were ongoing when you were still a party. And they’re not withdrawn yet, so they still have an ongoing obligation to arrest Netanyahu until they formally, officially withdraw. And also, after withdrawal, their obligation will still continue, as happened with the Philippines. So the Philippines also withdrew, but their obligation to arrest Duterte continued. And also quite ironically, and surprisingly, the Philippines did arrest Duterte, and he’s now in The Hague.“

STORYLINE:
Hungary said Thursday it will begin the procedure of withdrawing from the world’s only permanent global tribunal for war crimes and genocide.
The announcement came as Israeli Prime Minister Benjamin Netanyahu arrived in the Hungarian capital, Budapest, despite an international arrest warrant against him over his conduct of the war in the Gaza Strip.
Hungary’s government, led by right-wing populist Viktor Orbán, extended the invitation to Netanyahu in November after the ICC, based in the Hague, Netherlands, issued the warrant accusing him of crimes against humanity.
According a legal expert, however, withdrawing from the ICC would not remove Hungary’s obligation to arrest Netanyahu.
"Your obligation to cooperate continues for the cases that were ongoing when you were still a party. And they’re not withdrawn yet," explained Göran Sluiter, Professor of International Criminal Law at the University of Amsterdam.
"So they still have an ongoing obligation to arrest Netanyahu until they formally, officially withdraw. And also, after withdrawal, their obligation will still continue," he added.
