2. SOUNDBITE (English) Esha Bhandari, Attorney, American Civil Liberties Union:
"Rumeysa (Ozturk) has been detained for six weeks, and that, you know, that is far too long. Even one day of detention for writing an op-ed is just too long and violates the Constitution. And what we’re arguing to the court is that she should be allowed to have her day in court. The district court in Vermont is ready to hear her bail motion. It’s ready to decide if she can be released while these legal issues are working their way through the courts."

3. SOUNDBITE (English) Esha Bhandari, Attorney, American Civil Liberties Union:
"It’s a very simple ask. Release her on bail. She’s a cherished member of the Tufts community. She wants to finish her PhD. She’s scheduled to teach a class this summer. She should be released. Then the legal arguments can be dealt with."

4. SOUNDBITE (English) Esha Bhandari, Attorney, American Civil Liberties Union:
"The government is seeking to delay by making this emergency motion before the Court of Appeals. And we’re hoping that the Court of Appeals swiftly dismisses that so that the bail hearing can go on with Rumeysa present in court."

STORYLINE:
A federal appeals court has made no immediate decisions as it considers jurisdictional issues in the cases of a Turkish Tufts University student who’s been detained by immigration authorities for six weeks and a Palestinian student at Columbia University who was recently released from detention.
A judicial panel of the U.S. 2nd Circuit Court of Appeals, based in New York, heard motions Tuesday filed by the U.S. Justice Department regarding Rumeysa Ozturk and Mohsen Mahdawi.
The department is appealing decisions made by two federal judges in Vermont. It also wants to consolidate the students’ cases.
