"I think this was inevitable. I’ve talked to the US attorney and I know from months ago that they saw him as the top of the food chain, the person who probably had the highest ranking office and who did the most culpable act in breaching his duties as a Director of Goldman Sachs in revealing this information to a network of insider traders, so while he has fought with the FCC and won some battles there, he is ultimately going to have to convince a jury that there is nothing more than circumstantial evidence here, but there certainly is a lot of highly probative circumstantial evidence."

"The government’s problem is that the evidence is largely circumstantial. Mr. Gupta was tape recorded and jury in the Rajaratnam (Raj Rajaratnam, the 54-year-old convicted hedge fund founder who was the probe’s prime target) trial heard him disclose to others that he had a source at Goldman who had told him material news the day before. The government is going be able to show that the day before there were phone calls between the phone for Mr. Rajaratnam and the phone for Mr. Gupta, but that leaves an inference. We have Mr. Rajaratnam saying he got it from someone at Goldman and we have the phone calls, but there is going to be the defence claim that that is merely circumstantial and this is going to push, just what we mean by proof beyond a reasonable doubt."

"I think this is a black mark, maybe for corporate boards, I don’t think Goldman could have done anything to prevent this. This is a person who had an eminent business background, he was the Chief Executive officer at McKinsey’s, he was a director at many other companies and, if you believe the government story, he egregiously breeched his duties as a director, but there is no way a company can put in controls that stops a director who wants to be dishonest from being dishonest."

STORYLINE
A former board member of Goldman Sachs and Procter & Gamble pleaded not guilty on Wednesday to federal charges accusing him of acting as "the illegal eyes and ears in the boardroom" for a friend, a billionaire hedge fund founder sentenced this month to 11 years in prison in the biggest insider trading case in history.
The case, built partially on wiretaps used for the first time in insider trading, has offered unprecedented insight into greed at the highest levels of Wall Street.
The arrest of Rajat Gupta took it one step higher.
His lawyer called the allegations "totally baseless."
